NZS 3916:2013 Design and Build Contract Guide
A Practical Guide to NZS 3916:2013 - Design & Build Conditions of Contract
NZS 3916:2013 is New Zealand's standard form contract for design and build projects. It closely mirrors NZS 3910 but is adapted for the situation where the Contractor is responsible for both design and construction - creating a single point of accountability for the client. The overlap between the two standards is intentional, making it straightforward for parties who work across both contract types to move between them.
The key stakeholders are the same as under NZS 3910: the Principal commissions the works and pays the Contractor; the Contractor carries out the works and provides the design; the Engineer administers the contract impartially; and Subcontractors carry out specialist portions of the work nominated by the Contractor and agreed to by the Principal.
